President Biden asked the Department of Health and Human Services to provide a recommendation on how cannabis should be scheduled, which is currently at Schedule 1, or “no medicinal value.” Recently, HHS recommended to reschedule it to Schedule 3. This would eliminate the 280e tax penalty (link to blog post), and allow doctors to do research. But cannabis would still be federally illegal.
